MAY DAY GREETINGS


Is the day to salute pioneers, martyrs and the workers who have braved the trials and tribulations and resolve to unitedly continue the long march towards the total liberation of the working class from the chains that bind them (i.e.) the exploitation.

      On 1st May, 1886 the fourth convention of the Federation of organised Trade and Labour Union of the United States adopted a resolution demanding that eight hours only will constitute a day's legal labour.

      On May 4th, 1887, a demonstration was held at Hay Market Square (Chicago-USA) to protest against the brutal attack of the workers of MC, Cormack Reaper Works on 3rd May 1887. The police fired and killed. Blood flowed freely on the streets. The Red (Blood) flag was then hoisted as the flag of the working class. August Spice Engels, Fischer and Persons the Workers' leaders were trailed and sent to the gallows on 11th November 1887. August spice who mounted the gallows declared:

      "My defence is your accusation, the causes of my alleged crime your history. I say If death is the penalty for proclaiming the truth, I will profoundly and defiantly pay the cost price. Call your hangman."

      The heroes who mounted the gallows also declared:

      "The time will come when our silence will be more eloquent than our speeches."

      We have a lofty and great objective of eliminating, extinguishing and ending exploitation in any form or manner.

      In memory of these May Day Martyrs, all over the world, the working class observe the day as the 'Workers Day'. The first May Day was celebrated in 1890 in many countries of the world.

DAWN OF A NEW GDS ORGANISATION

The P&T Trade Union movement right from its inception had taken up the cause of the downtrodden Extra Departmental employees in the Postal. The NFPTE leadership  led by Dada Ghosh stood firm and not relented by declining to withdraw  the call of the indefinite strike  until the then Government conceded the demand for constitution of the ED Pay Committee called the Rajan Committee in 1957. Step by step improvements and in between snatching away of the hard won rights of this lowest strata of the postal workers by the authorities is the life storey of EDAs who are currently called as the GDS. NFPTE was denied the right to form a separate union as its affiliate in 1954 by the Government on the grounds that they are not regular employees. Even the latest New Recognition Rules follows the footsteps of the earlier policy and that is the background of the NFPE recognised without GDS Union affiliation.

However the NFPE succeeded in forming a strong union of GDS in 1999 because of the great role played by the then Secretary General NFPE Comrade K. Adinarayana. Despite his word was ‘gospel’ amongst the lakhs of GDS at that time and despite the situation that anyone named by him could win hands down as the General Secretary of the newly constituted AIPEDEU, he chose to accept the proposal of others and unanimous panel was elected at Kaiwara foundation conference of AIPEDEU. The magnanimity of Comrade Adinarayana was notonly not reciprocated by the leadership but step by step anti-NFPE platform became the bulwark of the AIPEDEU leadership. Trade Union democracy was butchered in its subsequent AICs to prevent any democratic forces capture the leadership.

The achievements if any gained by the EDAs or the GDS are purely because of the joint movement built up by the NFPE. But attacking the NFPE and its leadership at every available opportunity has become the basic strategy of AIPEDEU leadership. NFPE has been blamed for any failures on the part of the leadership of AIPEDEU. United movement and joint struggle have been the fundamental policy of the NFPTE and NFPE. But adventurist and individual action to undermine the NFPE and joint action in order to get cheap popularity had become the fundamental direction of AIPEDEU. All the efforts taken by the NFPE including measures to normalize the relation with the AIPEDEU to build a common movement in the interest of all postal employees both regular and GDS are always been nullified by the strategic ambition of the leadership of AIPEDEU to tarnish the Federation. Democratic traditions have been buried and major decisions including indefinite strikes and anti-NFPE actions have been taken without even convening the managing bodies like the CWC. The net result of the above course of action has resulted in huge losses to the three lakhs of GDS. The GDS became the target point of attack by the Authorities and Government due to the disunity created by the whole approach of the AIPEDEU. The mass of GDS are under attack but the AIPEDEU leadership has no answer except to blame the NFPE for all ills caused by its own failures.

The suffocation of large masses of GDS who always cherished the united movement under the banner of the NFPTE and NFPE have raised the above questions in the latest AIC of AIPEDEU in Mozri Conference and they have also raised so many questions about the mismanagement of the finances of union collected from the poor GDS all over the country. The leadership has no answer to the pointed questions of the delegates except to deny them their democratic opportunity to speak. At the height of the undemocratic attitude of the leadership, the delegates from several circles including many major circles condemned the leadership and came to the conclusion that any continuance under this undemocratic leadership will result in further huge losses to the GDS interests and a new organisation for the GDS has become the urgent requirement for launching united movement in advancing the cause of the downtrodden GDS masses. They came forward to form such a new organisation with the title “All India Postal Employees Union – GDS[NFPE]” there itself and elected an Adhoc Office Bearer body to form the union from grass roots to the apex level within a time frame of six months. Hundreds of delegates from several circles and hundreds of visitors attending the AIC have then walked out of the AIC and their huge and long procession ended in another accommodation ‘Shiv Mandir’ where they have conducted the first ever meeting of the new born organisation AIPEU-GDS[NFPE] and resolved to build the organisation and strive for united movement under the able guidance of the NFPE federation.

NFPE formed its first ED Union in 1999 to build a powerful joint movement but the effort was thwarted by the leadership with its own selfish goals and designs. Now a new organisation with the declared policy of united functioning under the guidance of NFPE and its affiliated regular employees’ organisations is born on 7th April, 2012. The P4 CHQ extends its warm congratulations to the leadership of the AIPEU-GDS[NFPE] and assures total cooperation at all levels from the CHQ to branch levels. The P4 organisation will stand shoulder to shoulder with the new formation and will fight to its potential as was the tradition created by our organisation under the leadership of Comrades V. G. Dalvi and K. Adinarayana. We hail the dawn of this new GDS organisation and wish it gains strength from strength organisationally and ideologically and emerge as the real champion of three lakhs of GDS masses.

COUNTING OF SERVICE RENDERED BY RESERVE TRAINED POOL (RTP) PERSONNEL PRIOR TO THEIR REGULAR APPOINTMENT AS POSTAL ASSISTANTS (PAs)/SORTING ASSISTANTS (SAs)-REGARDING.
D.G. Posts No. 44-1/2011-SPB.II dated 12 April, 2012.
I am directed refer to Directorate’s letter of even number dated 13.1.2011 on the above subject and to say that the issue of counting of service rendered by Reserve Trained Pool(RTP) personnel prior to their regular appointment as Postal Assistants(PAs)/Sorting Assistants (SAs) for promotion, seniority and grant of MACP was under consideration of the Directorate.
2. The RTP Scheme was introduced in the year 1980 as per which a panel of such persons was retained who could not be covered under the number of vacancies declared for regular appointment as PA/SA. When required they were detailed on duty on wages to be paid on hourly basis to meet the short time needs and current needs. The said RTP personnel were given priority for absorption against vacancies, which occurred subsequently. In the year 1983 the RTP personnel were given an option to opt for servicing Army Postal Services (APS).Such persons who opted so were appointed as PA/SA on ad-hoc basis and deputed to APS. The said RTP candidates deputed to APS were eligible to get the benefit of regular appointment in the Civil Post. The RTP scheme was abolished w.e.f. 4.3.1986.
3. While furnishing the information asked for from the Circles, the Orissa Circle has brought to the notice of the Directorate that three OAs filed by three officials in the Cuttack Bench of Hon`ble CAT seeking regularization of the services rendered under RTP scheme were dismissed on 10.4.2003 for the reason that the issue raised has already been decided by the Apex Court on 1.8.1997 in the case of UOI and another Vs K. Sivados and others in C.A. No. 80-123 of 1996
4. It is observed that Apex Court in their judgment dated 01.08.1997 has discussed the case in detail and has rejected the case for grant of Productivity Linked Bonus to RTP personnel. As regards grant of benefit of counting their services as RTP personnel for the purpose of their eligibility to appear for the departmental examination the Hon`ble Supreme Court in the same judgment has observed that the relevant rule provides that the candidate “ must have put in at least five years continuous satisfactory service in one or more eligible cadres” and hence pronounced that any service rendered by RTP personnel prior to their regular appointment in the cadre cannot count for the purpose of the said rule because it can not be considered as service in any eligible cadre. Thus, the Apex Court has held that Tribunal was wrong in granting to RTP personnel the benefit of service rendered by them prior to their regular appointment, for the purpose of their eligibility to appear for the departmental promotion examination.
5. In another case Hon`ble Supreme Court in C.A. No. 5739 of 2005 in the case of UOI Vs Shri Mathivanan vide their judgment dated 9.6.2006 has held that ad-hoc service rendered in APS by RTP personnel should be counted for the purpose of grant of financial upgradation under TBOP scheme. This was mainly due to the fact that the said Scheme did not mention the requirement of ‘regular service’ in para 1 of the Scheme for being eligible for grant of financial upgradation under TBOP scheme .In fact, the Hon1ble Supreme Court observed that it was not a case where promotion to the higher post is to be made only on the basis of seniority. Keeping in view the Apex Court’s decision in M. Mathivanan’s case and the fact the TBOP is not to be granted on the basis of seniority, it was decided to extend the benefit of the Apex Court’s order to similarly placed serving officials vide Directorate’s letter No. 93-25/2003-SPB.II dated 26.7.2010.
6. As per MACP scheme, the officials are eligible for grant of three financial upgradations on completion of 10, 20 and 30 years of service respectively. For the purpose, it has been laid down that ‘regular service’ for the purpose of the MACPs shall commence from the date of joining of a post in direct entry grade on a regular basis either on direct recruitment basis or on absorption /re-employment basis. It has been categorically stated that the service rendered on ad-hoc/contract basis before regular appointment on pre-appointment training shall not be taken into reckoning.
7. In view of the judgment dated 01.08.1997 delivered in C.A. 80-123 1996 in the case of UOI & another Vs K.N.Sivados and others and provisions contained in MACP scheme, it has been decided by the Competent Authority that the service rendered under RTP scheme by the personnel prior to their regular appointment as PA/SA can not be counted for promotion , seniority and grant of MACP.
8. The above decision may be taken into consideration while defending the court case. The representations received on the subject may also be dealt with accordingly.

Respected Sirs,

I am arrive by passenger train Ahmedpur station and my belly is too much swelling with jackfruit. I am therefore went to privy. Just I doing the nuisance that guard making whistle blow for train to go off and I am running with lotaah in one hand and dhoti in the next when I am fall over and expose all my shocking to man and female women on platform. I am got leaved at Ahmedpur station. This too much bad, if passenger go to make dung that dam guard not wait train five minutes for him. I am therefore pray your honour to make big fine on that guard for public sake. Okhil Babu wrote this letter to the Sahibganj divisional railway officer in 1909. It is on display at the Railway Museum in New Delhi. It was also reproduced under the caption Travellers
Tales in the Far Eastern Economic Review.

Consequent upon increase of Dearness Allowance to Central Government Employees drawing 6 CPC scales, the Govt. has decided to increase the rates of DA for Officers who continue to draw their salary as per pre revised 5th CPC scales.  The rate of DA has been enhanced from the existing rate of 127% to 139% w.e.f. 01.01.2012.

            The undersigned is directed to refer to this Departments O.M. of even No. dated 17th October, 2011 revising the Dearness Allowance w.e.f. 1.7.2011 in respect of the employees of the Central Government and the Central Autonomous Bodies who continue to draw their pay and allowances in the pre-revised scales of pay as per 5th Central Pay Commission.
 2.         The rates of Dearness Allowance admissible to the above categories of employees of the Central Government and the Central Autonomous Bodies shall be enhanced from the existing rate of 127% to 139% w.e.f. 01.01.2012. All other conditions as laid down in the O.M. of even number dated 3rd October, 2008 will continue to apply.
3.         The contents of this Office Memorandum may also be brought to the notice of the organizations under the administrative control of the Ministries/Departments which have adopted the Central Government scales of pay.

All CGHS dispensaries have been directed to issue medicines including local purchase medicines to the beneficiaries holding valid CGHS card attached to any dispensary.
Instructions have already been issued in this regard by the Ministry.

Dear Comrades,
History has its own course. Nobody can prevent it.
The Gramin Dak Sevaks (GDS) Union was formed in the year 1999 by NFPE with the guidance and blessings of Com. K.Adinarayana, the Legendary Leader who scarified his whole life for the emancipation of GDS. But the union was hijacked by a group of persons who are totally against NFPE and thus Com. Adi and NFPE was cheated. They even prevented the GDS employees from shouting the slogan - “NFPE ZINDABAD”. They looted the GDS money in lakhs and crores. They purchased flats and buildings. All the benefits achieved by the NFPE through continuous struggle was snatched away by the Government one by one during the period from 1999 to 2011. Sufferings of the GDS increased but the ‘anti-NFPE group” could not do anything. Neros were fiddling when the Rome was burning. They continued to blame NFPE for their inefficiency. They published open letters in their journal challenging the NFPE leadership.
Through money power and muscle power this “anti-NFPE group” tried to silence all those who questioned the leadership and those protested were sent out of the union in a most undemocratic manner and adhoc-committees were appointed dismissing the duly elected bodies. Even in the earlier All India Conference, GDS delegates who contested against the leadership were not allowed to contest and were brutally attacked and thrown out from the conference hall.
It is at this juncture, the majority of the GDS delegates who attended the All India Conference held at Amaravathi decided to shape their own destiny. The new union of the GDS called “All India Postal Employees Union GDS (NFPE)” was formed on 7th April 2012 by the majority of the delegates. Thus the broken link of GDS with NFPE is restored after a long gap of twelve (12) years. Those black days are over. Once again the GDS are going to march forward under the banner of NFPE. We shall fight together for the cause of GDS. We shall fight against the Govt. which is totally unsympathetic towards the three lakhs Gramin Dak Sevaks.
In this joint struggle we shall abide by the great traditions of Com. Tarapada Mukherjee, Dada Ghosh, K.G.Bose, N.J.Iyer and Com. Adinarayana. Com: Adi, who fought many a battle for the emancipation of GDS shall be our guiding spirit and the mighty National Federation of Postal Employees (NFPE) shall be our hope and inspiration.
We shall restore the pride and honour of three lakhs Gramin Dak Sevaks. We shall unleash series of struggle including strike exclusively for realisation of the GDS demands. We shall restore our past fighting tradition and the glory of GDS.

On this occasion of launching the new website for the GDS, NFPE extend its warm greetings to the three lakhs Gramin Dak Sevaks.
Let us march ahead with determination.
